Terms and Con­di­ti­ons for On­go­ing Cour­ses

1. Scope

The ge­ne­ral terms and con­di­ti­ons apply to all con­trac­tu­al re­la­ti­onships bet­ween the Cam­bridge In­sti­tut and its custo­mers. By signing the re­gis­tra­ti­on form, the custo­mer ack­now­led­ges the va­li­di­ty of the ge­ne­ral busi­ness re­la­ti­onships. Con­tra­dic­to­ry or de­via­ting terms and con­di­ti­ons of the custo­mer are not re­co­gni­zed by the Cam­bridge In­sti­tut. No oral col­la­te­ral agree­ments have been made. Chan­ges or ad­di­ti­ons to the agree­ment re­qui­re writ­ten form. The writ­ten form re­qui­re­ment can­not be wai­ved.


2. Con­clu­si­on of Con­tract

The con­tract is con­clu­ded at the agreed con­di­ti­ons by signing the re­gis­tra­ti­on form. The re­gis­tra­ti­on is bin­ding. The mi­ni­mum par­ti­ci­pa­ti­on pe­ri­od for an on­go­ing cour­se is one ca­len­dar month and is ex­ten­ded by one ca­len­dar month until the ti­me­ly ter­mi­na­ti­on on the 20th of the pre­vious month (see point 7).


3. Cour­se Fee

3.1. The cour­se fee is to be paid in full in ad­van­ce for each ca­len­dar month wit­hout being re­ques­ted. Pa­y­ment must be made by the 1st of each month, or a de­cla­ra­ti­on of as­sump­ti­on of costs from the em­ploy­er must be sub­mit­ted by this time. The cour­se fee is only valid for the re­spec­ti­ve due month and is not trans­fera­ble to ano­ther pe­ri­od.

3.2. Pa­y­ment is made by de­po­si­ting the amount into one of the ac­counts lis­ted below. There is also the op­ti­on of gran­ting a di­rect debit au­tho­riza­ti­on using the at­ta­ched form or pa­y­ment in cash/EC card at the re­gis­tra­ti­on.

3.3. The amount of the cour­se fees can be found in the valid fee sche­du­le and re­fers to one ca­len­dar month, re­gard­less of the num­ber of cour­se days. No fee is char­ged for the month of Au­gust.

3.4. The custo­mer can­not claim com­pen­sa­ti­on (make-​up clas­ses), in par­ti­cu­lar, a re­fund of the cour­se fee for unu­sed les­sons.

3.5. The cour­se fee is not trans­fera­ble to other per­sons/par­ti­ci­pants.


4. Ad­van­ce Pa­y­ment

4.1. A dis­count of 5% or 10% is gran­ted on the total in­voice amount for ad­van­ce pa­y­ment of 3 or 6 cour­se months, re­spec­tive­ly.

4.2. A dis­count can only be given for the ori­gi­nal­ly sel­ec­ted cour­se.

4.3. There is no re­fund of the (par­ti­al) cour­se fee for ser­vices not used.

4.4. In in­di­vi­du­al cases, a break in par­ti­ci­pa­ti­on or a chan­ge to ano­ther cour­se can be agreed upon after con­sul­ta­ti­on. A re­boo­king fee of €40.00 is due for this.


5. Chan­ge of Cour­se

A chan­ge of cour­se is ge­ne­ral­ly pos­si­ble free of char­ge de­pen­ding on ca­pa­ci­ty and can be re­ques­ted for the fol­lo­wing ca­len­dar month (ex­cep­ti­on: see point 4.4).


6. Amend­ment/Non-​Performance

The Cam­bridge In­sti­tut re­ser­ves the right to can­cel a cour­se, chan­ge the time con­di­ti­ons and con­tent of the cour­se, or offer the par­ti­ci­pants ano­ther cour­se if the mi­ni­mum num­ber of par­ti­ci­pants for the boo­ked cour­se is not re­a­ched.


7.Ter­mi­na­ti­on and Can­cel­la­ti­on

7.1. The custo­mer can ter­mi­na­te the con­tract each month until the 20th of the month for the fol­lo­wing month. The can­cel­la­ti­on pe­ri­od also ex­pi­res on Sun­days and pu­blic ho­li­days be­cau­se can­cel­la­ti­on on­line is pos­si­ble on these days. The sta­tu­to­ry re­gu­la­ti­ons of § 193 of the Ger­man Civil Code do not apply. 

7.2. If the con­tract is not ter­mi­na­ted in due time, it will be ex­ten­ded by ano­ther ca­len­dar month.

7.3. Can­cel­la­ti­on of the con­tract is pos­si­ble be­fo­re the start of the cour­se and on the first day of the cour­se in the con­tract pe­ri­od. The re­gis­tra­ti­on will be can­ce­led free of char­ge.

7.4. The ter­mi­na­ti­on or with­dra­wal must be made in wri­ting.

7.5. If the par­ti­ci­pant is not sa­tis­fied after the first day of the cour­se du­ring the con­tract term, the re­gis­tra­ti­on can be can­ce­led in wri­ting within 2 days wit­hout gi­ving re­a­sons. In this case, 100% of the cour­se fee will be re­fun­ded to the par­ti­ci­pant.

7.6. In case of a late with­dra­wal, the full cour­se fee for the re­spec­ti­ve ca­len­dar month must be paid.


8. De­fault

8.1. If the cour­se fee is not paid by the 1st of the re­spec­ti­ve cour­se month in ad­van­ce, the custo­mer is in de­fault wit­hout a re­min­der from the Cam­bridge In­sti­tut.

8.2. In this case, the Cam­bridge In­sti­tut re­ser­ves the right to pro­hi­bit par­ti­ci­pa­ti­on in the cour­se until pa­y­ment is made.

8.3. In case of de­fault, the custo­mer must reim­bur­se all de­fault da­ma­ges, such as re­min­der fees of €10.00 per re­min­der, and de­fault in­te­rest, re­gard­less of other claims.


9. Ap­pli­ca­ble Law

9.1. The law of the Fe­de­ral Re­pu­blic of Ger­ma­ny ex­clu­si­ve­ly ap­plies to the con­trac­tu­al re­la­ti­onship and its exe­cu­ti­on.

9.2. If the custo­mer is a mer­chant, a legal en­ti­ty under pu­blic law, or a spe­cial fund under pu­blic law, or if the custo­mer does not have a ge­ne­ral place of ju­ris­dic­tion in the Fe­de­ral Re­pu­blic of Ger­ma­ny, Mu­nich is agreed as the place of ju­ris­dic­tion for all dis­pu­tes ari­sing from this con­trac­tu­al re­la­ti­onship. Other­wi­se, the sta­tu­to­ry place of ju­ris­dic­tion ap­plies. If in­di­vi­du­al pro­vi­si­ons of these terms and con­di­ti­ons are in­ef­fec­ti­ve or void, this does not af­fect the ef­fec­ti­veness of the re­mai­ning pro­vi­si­ons.
